Terms of Service

1. Who we are
Prospect University (“Prospect University,” “we,” “us”) operates the website at prospect.university (the “Site”) and the online course, downloads, community access, and related services offered through it (together, the “Services”). By creating an account, making a purchase, or otherwise using the Services, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Services.

2. Eligibility and parents/guardians
The Services are designed for student-athletes, including athletes under 18. You must be at least 13 years old to create an account or use the Services. The Services are not directed to, and may not be used by, children under 13.
If you are under 18, you may only use the Services with the knowledge and consent of a parent or legal guardian, and any purchase must be made or authorized by a parent or legal guardian. By allowing a minor to use the Services, the parent or guardian agrees to these Terms on the minor’s behalf and is responsible for the minor’s use of the Services.
3. Accounts and access
Some parts of the Services require an account. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. Access to paid content is tied to the email address used at purchase; course access is personal to you and may not be shared, resold, or transferred.
4. Purchases, tiers, and payment
We offer a free starter tier and paid tiers whose current prices and inclusions are shown on our pricing page. Prices may change at any time, but changes will not affect purchases you have already completed.
Payments are processed by Stripe. We do not receive or store your full card details. By purchasing, you authorize the charge for the tier you select and represent that you are authorized to use the payment method provided.
5. 14-day refund policy
If you are not satisfied with a paid tier for any reason, email cullen@prospect.university within 14 days of your purchase and we will issue a full refund to your original payment method. After 14 days, purchases are non-refundable except where required by law. If a purchased tier includes a live 1:1 session that has already been delivered, we may deduct the reasonable value of that session from the refund.
6. Our content and your license
All course materials — videos, scripts, workbooks, PDFs, graphics, frameworks, and the Prospect University name and branding — are owned by us or our licensors and are protected by intellectual property laws. When you purchase or unlock a tier, we grant you a personal, non-exclusive, non-transferable license to access the included materials for your own education. You may not copy, record, redistribute, publicly post, resell, or share the materials or your account access with others.
7. Community spaces
Some tiers include access to community spaces (such as a Discord server). Those spaces are also governed by the platform’s own terms and rules. Be respectful: no harassment, hate, spam, impersonation, or posting of other people’s private information. We may remove content or revoke community access at our discretion to keep the community safe, without a refund where the removal results from a violation of these Terms.
8. Educational content only — no guarantees
The Services teach strategies for building a personal brand and pursuing NIL (name, image, and likeness) opportunities. They are provided for educational purposes only. We do not guarantee any particular outcome — including follower growth, brand deals, NIL income, scholarships, or recruiting results. Any examples or case studies describe specific athletes’ experiences and are not a promise of similar results.
Nothing in the Services is legal, financial, tax, or compliance advice. NIL rules vary by state, school, athletic association, and division, and they change frequently. You (and your parent or guardian) are responsible for complying with the rules that apply to you, and should consult your school’s compliance office or a qualified professional before entering any NIL agreement.
9. Acceptable use
You agree not to misuse the Services — including attempting to access content or accounts you are not entitled to, scraping or harvesting data, interfering with the Site’s operation, circumventing payment or access controls, or using the Services for anything unlawful.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you materially violate these Terms (including sharing paid content or abusing community spaces). If we terminate your access without cause, we will refund a prorated or reasonable portion of any recent purchase.
11. Disclaimers and limitation of liability
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, and our total liability to you for any claim arising out of or relating to the Services is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above, and for material changes we will take reasonable steps to notify you (such as email or a notice on the Site). Continuing to use the Services after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to their jurisdiction.
